Garage Sale Restrictions
I'm no attorney, but what the following mean to me is that as long as I'm somewhere within City limits I'd owe tax on my sales revenue if, within one year, I sold more than 3 of my cars or had more than 3 garage sales. Further, I could only have 2 garage sales from my place of residence. If I were to have a 3rd garage sale from my residence, I'd be subject to a $2000 fine for each day of the sale.


Reg. 14-310.2.  "Casual" exemption of activities from the licensing requirements of section 14-310.

Individuals, other than those engaging in rental of real property, may be considered as engaged in "casual" activities, and not subject to the annual fee imposed under section 14-310, provided that they are engaged in activities such as the private sale of personal automobiles, garage sales, and the sale of homemade artifacts, on no more than three separate occasions during any calendar year.

h. Garage or yard sales may be conducted twice every twelve months on any residentially zoned property occupied by a dwelling unit. Any sale shall not exceed the time period of three consecutive days.

Section 1004.  Penalties. +1 *2
Any owner, occupant, lessor, lessee, tenant, manager, licensee, or other person having control over or use of a structure or parcel of land who causes, permits, facilitates, or aids or abets any violation of any provision of this Zoning Ordinance or a failure to perform any act or duty required by the Zoning Ordinance is guilty of a Class 1 misdemeanor, provided, however, that the City Attorney may authorize the filing of certain cases or classes of cases as civil violations subject to a civil sanction of not more than two thousand five hundred dollars per day. Each day a violation of any provision of the Zoning Ordinance or a failure to perform any act or duty required by the ordinance exists may constitute a separate offense.
